RULES AND REGULATIONS, RELEASE OF CLAIMS, AND ASSUMPTION OF RISK AGREEMENT This Rules and Regulations, Release of Claims, and Assumption of Risk Agreement (the “Agreement”) is between 806 IRB LLC, a Florida limited liability company (“Owner”), and the undersigned person (“User”), effective as of the date executed by User. RECITALS A. Owner operates a short-term vacation rental dwelling located in the State of Florida at 806 First Street, Indian Rocks Beach, FL 33785 (the “Premises”). B. User desires to rent the Premises on a short-term basis and has reserved the Premises pursuant to a separate agreement and/or terms and conditions (as applicable, the “Short-Term Rental Agreement”). C. User further desires to use certain amenities and equipment that may be located on or about the Premises, including, without limitation, an elevator, multiple balconies and rooftop areas, an outdoor kitchen with a gas grill, a gym, a game room, a cold plunge, and an outdoor spa (collectively, the “Amenities”). D. Subject to the terms and conditions of the Short-Term Rental Agreement and this Agreement, Owner is willing to rent the Premises to User, and permit User to use the Amenities, for the period set forth in the Short-Term Rental Agreement or reservation confirmation (the “Stay”). NOW, THEREFORE, in consideration of the mutual obligations contained herein, and other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, the parties agree as follows: AGREEMENT 1. USE OF PREMISES. User’s use of the Premises is limited to that of a short-term, transient vacation/retreat rental. User acknowledges and agrees that User is a guest, transient occupant, and licensee only, and is not a tenant, lessee, or holder of any leasehold estate in the Premises. User further acknowledges and agrees that the Stay is temporary, that the Premises are not User’s sole residence, domicile, homestead, or permanent address, and that User has no tenant rights under Part II of Chapter 83, Florida Statutes, including because transient occupancy in a hotel, condominium, motel, roominghouse, or similar public lodging is excluded from Part II under Section 83.42(3), Florida Statutes. User will have no other rights to the Premises other than as a short-term licensee. Use of the Premises shall commence at 4:00 p.m. on the day of check-in and promptly terminate at 10:00 a.m. on the day of check-out unless Owner agrees to a different schedule in writing. If User, any Minor, or any Visitor remains at the Premises after checkout or after Owner directs the person to leave, Owner may exercise all rights and remedies available under the Short-Term Rental Agreement, this Agreement, and Florida law, including any remedies applicable to transient occupants or unauthorized occupants. During the Stay, all Users and Visitors must strictly observe and abide by the Short-Term Rental Agreement, this Agreement, the rules and regulations attached hereto as Addendum 1 (the “Rules and Regulations”), and any rules, regulations, instructions, or directives from Owner that are posted within the Premises or otherwise transmitted by Owner. 2. OCCUPANCY LIMITS. The maximum number of persons authorized to use the Premises shall be the number stated on User’s reservation confirmation, regardless of whether such persons are staying overnight or visiting (“Visitors”). The Premises may not be used for any party, event, or gathering without Owner’s prior written approval and full payment of any additional fees associated with such party, event, or gathering. Notwithstanding the foregoing, delivery persons (e.g., food providers, Uber drivers, taxi drivers, or similar persons) who promptly leave after delivery or pick-up are permitted to enter the Premises for that limited purpose. The booking User and all Visitors must be at least 18 years of age. Any Minor may be present only if permitted by Owner and continuously supervised by the Minor’s parent or legal guardian. Rules and Regulations, Release of Claims, and Assumption of Risk Agreement 2 3. MINORS. For purposes of this Agreement, a “Minor” means any person under the age of 18. If any Minor is among the Users or Visitors, the Minor’s parent or legal guardian is solely responsible for the Minor’s supervision, safety, conduct, and compliance with this Agreement throughout the Stay. The Amenities present heightened risks to Minors and Minors may not use any Amenities except with, and under the direct supervision of, a responsible adult User, subject to the age restrictions stated in the Rules and Regulations. 4. REPRESENTATIONS AND WARRANTIES. 4.1 User represents and warrants that User has caused all other Users and Visitors, permitted or otherwise, to read this Agreement, or has otherwise informed them of its material terms, and that each such person is required to comply with this Agreement, the Short-Term Rental Agreement, and the Rules and Regulations. The undersigned is solely responsible for communicating the rules, risks, and safety requirements described in this Agreement and the Rules and Regulations to every member of the booking party and to every occupant and Visitor. 4.2 The undersigned User acknowledges and agrees that User is executing this Agreement on behalf of User and all members of the booking party, including any Minors and Visitors. By signing below, User represents and warrants that all individuals in the booking party have read, understand, and agree to be bound by the terms, conditions, and liability waiver associated with this reservation, or that User has authority to bind such persons to the fullest extent permitted by law. User further agrees to assume full responsibility for the conduct, compliance, and actions of all members of the booking party, all Visitors, and any Minors present at the Premises during the Stay. User also acknowledges and agrees that no individuals other than those disclosed and confirmed at the time of booking are permitted to stay at the Premises. Any individual not included in the original booking confirmation (whether a Visitor or otherwise) may only be present for a limited visit of a few hours unless Owner approves otherwise in writing. Any overnight stay by an undeclared individual shall constitute an unauthorized guest and may result in additional charges, penalties, removal, or immediate termination of the reservation, as determined by Owner. 4.3 If a Minor is among the Users or Visitors, the Minor’s parent or legal guardian represents and warrants that such parent or legal guardian has read this Agreement, agrees to its provisions on the Minor’s behalf to the fullest extent permitted by Florida law, and accepts sole responsibility for the Minor’s supervision and conduct. User agrees that User’s release of claims and liability, assumption of risk, and indemnification obligations under this Agreement will extend to such Minor, any acts or omissions of such Minor, and any Claims associated with such Minor, to the fullest extent permitted by Florida law. 4.4 NO PETS ARE ALLOWED. 4.5 By using any particular Amenity, User represents and warrants that User and its Visitors are physically, mentally, and medically capable of safely using such Amenity and have not been advised by a medical professional to avoid such Amenity. 4.6 User represents and warrants that User will pay, and has the ability to pay, for all damage, loss, missing items, extra cleaning, fines, charges, penalties, and other amounts caused by or attributable to any User, Minor, or Visitor during the Stay. User will return the Premises and the Amenities in substantially the same condition in which they were received, excluding normal wear and tear. Subject to the Short-Term Rental Agreement and applicable law, Owner may withhold all or part of User’s deposit, charge any authorized payment method, and/or pursue legal action if there is a failure to abide by this Agreement, any addenda, the house manual, the Short-Term R...

This property has special local compliance requirements which include a signed rental agreement, ID verification, and a security hold of $2000 (which is not a traditional security deposit, just a pending transaction). As an optional alternative to the security hold, you may opt in to purchase a non-refundable damage waiver provided by a third-party insurance company. The optional damage waiver is $99 for stays up to 10 nights, with an additional $2 per day for stays longer than 10 nights. Damage waiver purchases are optional.
